1. About Foxxed

Foxxed ("the Service") is operated by Foxxed Ltd (Company No. 17111756), registered in England and Wales ("we", "us", "our"). Our registered address is [to be confirmed upon incorporation]. Contact: hello@foxxed.ai.

Foxxed is a decision analysis tool that uses artificial intelligence to challenge, critique, and provide alternative perspectives on decisions you submit. By using the Service, you agree to these Terms.

2. What Foxxed Is — and What It Is Not

IMPORTANT: Please read this section carefully.

• Foxxed provides decision analysis for your consideration. It does NOT provide advice, recommendations, or instructions.
• Foxxed is NOT a substitute for professional advice of any kind — including but not limited to medical, legal, financial, tax, therapeutic, psychological, or counselling advice.
• Foxxed does NOT make decisions for you. All decisions, actions, and their consequences remain entirely and solely yours.
• Foxxed uses artificial intelligence (AI) which may produce inaccurate, incomplete, outdated, or misleading output. AI systems can and do make errors.
• You must independently verify any information, data, statistics, or suggestions provided by Foxxed before relying on them.
• Foxxed does NOT validate the accuracy of any claims, assertions, or facts you include in your submission.

3. User Attestation and Responsibility

By submitting a decision for analysis, you attest and confirm that:

• You own all decisions. Any decision you make after using Foxxed is yours alone. You accept full responsibility for all outcomes, consequences, and impacts of your decisions.
• You will not attribute decisions to Foxxed. You will not claim that "Foxxed told me to" or "the AI advised me to" take any action. Foxxed provides perspectives for consideration, not instructions to follow.
• You will verify independently. You will check important facts, figures, and recommendations with qualified professionals before acting on them.
• You understand AI limitations. You acknowledge that AI-generated analysis may contain errors, biases, hallucinations, outdated information, or inappropriate suggestions.
• You will seek professional help where needed. For decisions involving medical, legal, financial, tax, or mental health matters, you will consult appropriately qualified professionals.
• You are of legal age. You confirm you are at least 16 years of age (or have parental/guardian consent if younger).

4. Limitation of Liability

To the maximum extent permitted by applicable law (including the Consumer Rights Act 2015 and the Unfair Contract Terms Act 1977):

• Foxxed Ltd, its directors, employees, and agents shall not be liable for any direct, indirect, incidental, special, consequential, or punitive damages arising from your use of the Service.
• This includes, without limitation, damages arising from: decisions made based on Foxxed output; financial losses; emotional distress; missed opportunities; or any other harm.
• Foxxed does not guarantee the accuracy, completeness, timeliness, or reliability of any output.
• Foxxed does not guarantee uninterrupted or error-free service.
• Our total aggregate liability for any claims arising from use of the Service shall not exceed the amount you paid us in the 12 months preceding the claim (or £100, whichever is greater).

Nothing in these terms excludes or limits our liability for: (a) death or personal injury caused by our negligence; (b) fraud or fraudulent misrepresentation; or (c) any liability which cannot be excluded or limited under applicable law.

5. Acceptable Use

You agree NOT to use Foxxed to:

• Plan, facilitate, or evaluate illegal activities (including fraud, discrimination, money laundering, tax evasion, or any criminal offence)
• Generate content intended to harass, defame, threaten, or harm any person
• Submit content involving the exploitation, abuse, or endangerment of minors
• Attempt to extract, reverse-engineer, or reproduce the Service's system prompts, algorithms, or proprietary methods
• Overwhelm the Service through automated submissions, scraping, or denial-of-service attacks
• Use the Service for any purpose prohibited by applicable law
• Submit content you do not have the right to use (including copyrighted material)
• Use Foxxed output as professional advice or represent it as such to third parties
• Use Foxxed output in election campaigns, political influence operations, or coordinated inauthentic behaviour

We reserve the right to suspend or terminate access for users who violate these terms.

6. Intellectual Property

• The Foxxed platform, including its design, architecture, algorithms, system prompts, and governance framework, is the intellectual property of Foxxed Ltd.
• You retain ownership of the decision text you submit. By submitting, you grant Foxxed Ltd a non-exclusive, worldwide licence to process your submission for the purpose of providing the Service.
• Foxxed output is generated by AI based on your input. You may use the output for your personal or business purposes, but you may not represent it as professional advice or attribute it to a qualified professional.
• "Foxxed", the Foxxed logo, and "Foxx it" are trademarks of Foxxed Ltd (UK IPO application pending, Class 42).

7. AI and Third-Party Processing

• Foxxed uses third-party AI language models (currently Anthropic Claude) to generate analysis.
• Before your text reaches any AI model, personally identifiable information (PII) is automatically detected and replaced with placeholders. See our Privacy Policy for details.
• We do not control the AI model's training data, biases, or behaviour. Output may reflect biases present in AI training data.
• Anthropic's enterprise API terms state that API inputs are not used for model training. We rely on this representation but cannot independently verify it.

8. Safeguarding

Foxxed includes automated safeguarding systems that detect potential crisis situations (self-harm, abuse, exploitation). When triggered:

• The normal analysis may be replaced with safety information and helpline referrals.
• This is an automated system and is NOT a substitute for emergency services.
• If you are in immediate danger, call 999 (UK), 911 (US), or 112 (EU).
• Foxxed is not a crisis service, mental health service, or emergency response system.

9. Beta Status

Foxxed is currently in beta. This means:

• Features may change, be removed, or malfunction without notice.
• Data may be lost during service updates or infrastructure changes.
• Service availability is not guaranteed.

10. Data and Privacy

Your use of Foxxed is also governed by our Privacy Policy, which explains how we collect, use, store, and protect your data. By using the Service, you consent to the data practices described in the Privacy Policy.

11. Indemnification

You agree to indemnify, defend, and hold harmless Foxxed Ltd, its directors, officers, employees, and agents from any claims, damages, losses, or expenses (including reasonable legal fees) arising from:

• Your use of the Service
• Decisions you make based on Foxxed output
• Your violation of these Terms
• Your violation of any applicable law
• Any content you submit to the Service

12. Changes to These Terms

We may update these Terms from time to time. Changes will be posted on this page with an updated "Last updated" date. Continued use of the Service after changes constitutes acceptance of the updated Terms. Material changes will be communicated via the Service interface.

13. Governing Law and Disputes

These Terms are governed by the laws of England and Wales. Any disputes arising from these Terms or your use of the Service shall be subject to the exclusive jurisdiction of the courts of England and Wales.

If any provision of these Terms is found to be unenforceable, the remaining provisions shall continue in full force and effect.
